my bro and his gf had their baby back in september and they have been living with me and my family since october. they moved in with us bcuz her mom has been living in hotels and couldnt provide a stable place for them to live she is only 17 but turns 18 in april. her mom is now trying to force her to to come and live with her and take the baby away from my bro. my bro and his gf are still together as a couple. he is 18 and is being sued by her mother on her(gf's) behalf for child support. now her mom is threatening to call the cops if gf doesnt come and live with her and bring the baby. bcuz gf is only 17 she can do that and gf legally had to go back with her. she lives in a craphole and does drugs. my bro is filing for custody but what can he do in the meantime?? is there anyway that gf can leave but baby can stay??

Make her mom take her to court. Because of her mom's history and the fact that her daughter has been living away from home will more than likely relinquish parental rights at this point. Her mom is not providing guardianship now and certainly can't take care of herself.

This is just a scare tactic. I'm sure no court would side with her mother. If she does start this legal process (the daughter will be offically served via a sherrif usually) have her see an attorney. If the mother is making a stink for nothing than the mother can be made to bare her daughter's attorney costs.

Not all states emancipate teens when they have babies and some don't do it anymore under any circumstances. In some states at 17 the girl could live where she chooses, in others she would be forced to return home. The worse news is the mother would be held accountable if anything happened to her baby in either environment. This girl and your brother are in a mess, in most states the legal age of consent is 17 or younger. HOWEVER in a lot of states any 18 year old or older who has sex w a minor can still be charged w sexual misconduct. Its a far lesser charge and wont result in your brother being listed as a sex offender but still could pose a problem in family court. There are great differences in how each state would treat this mess, someone should call your DDS/cps etc anonymously and ask questions to see what the mother's rights are in her state and how much trouble the father could end up in before taking any action.

She can either sign custody for your bro for the 2 months until she turns 18 or she can get emancipated. Obviously your her mother is not in a positon to have a baby wit her. Dont worry about her threatening to call the cops. I am a cop and most of us are not idiots. We see crazy druggie mother, and her craphole house, we are not letting her take a child back in the house.

Well unfortunately the girl's mother can do this. But the father of the baby can call Child Protection Services and explain that he is the father of the child and he does not agree with the living arrangements of his child and get temporary custody of his baby. Meanwhile the 'grandmother' will have to let the child go and then it will be brought to court. It will take the mother of the baby to stand up and say that she does not want the child living with the grandmother as well and request that she be emansipated as well. Fathers have rights and should be allowed to use them. I am not sure what state you live in .. or I would attach some websites.

Well first of all after you have a baby you are automatically emancipated. The girl is in charge of her and her babys life, so her mother is lying. If it comes down to it, call the cops to the mothers house to get the daughter out, or call because there is drug use going on. If your brother wants custody, then her needs to call the cops on his gilrfirned for drug use so that the court can see what kind of mother she is.

If that is what GF wants she can sign over custody and leave for the 2 months until she is 18. That is only if the GF is up for it. Try to explain to her that you guys are not trying to take the baby but that you just want what is best for him/her. Good luck

What evidence do you have that the gf's mother does drugs? The best thing would be to get a lawyer and try to prove that your home is a better place for the child. Your brother should marry this girl (why didn't he marry her?) and he absolutely should be paying child support if he doesn't marry her.

first off, someone said she is automatically emancipated if she has a baby NOT TRUE! but if her mother is being as she, she CAN get emancipated. unless ur brother doesnt want to be with his gf, then why would u make her leave her baby? thats not fair, DO NOT make her lose her child unless she is the one doing drugs and things like that. have her get emancipated thats the best choice for the child and the mother.
