Just deposit them and wait a few weeks and see if the money stay or leave in a few weeks.

That may depend on whether a) a stop-payment was issued for it or b) the check is older than 6 months. Under the Uniform Commercial Code, a check whose date is more than six months before the date it is presented to the payor bank may treat it as a stale check and refuse to honor it. You can certainly try depositing it in your bank, but you risk incurring charges as the banks sent it back. Better to present it to the bank it is drawn on. The bank will either pay it or not, but you won't have any fees or charges if it is refused.

If you know the check was replaced and you got the money, you could be tried for larceny.

They are probably Stale so to speak but maybe not. You need to bring them along to your bank and a teller will advise you. If you just deposit them electronically you may incur expenses if the checks are stale or bounce

Yes -- funds should be available to cover them . The best way is to simply deposit them in a checking account. Your company's payroll person(s) won't be happy but it is your money.

Normally 6 months is the life of a cheque.

Other than that write to the account holder and request a new one...
