I was out of state and thru online classifieds found a phone for sale in my home town. I had my girl friend buy it for me. After she took it home and charged it, she found that the phone was still active. I called the owner (the person I bought it from) and told her the situation and she told me that she called Verizon to cancel but they were gonna charge her to cancel the contract and since it was a 2nd phone on her family plan she said that I could pay her $10 a month and get 700 mins. I told her, I only need the phone. She said she will call verizon and work something out .... well its been 3 weeks, she is not returning my phone calls... i call her like everyday... I called Verizon - they said they cant do anything since she hasnt cancelled. I cant use the phone cos its not mine. I cant sell it, verizon called her thru a 3 way conference and she told them she didnt sell any phone. I dont know where she lives. I cant get in contact with her ...what can I DO????? I hope it makes sense

NOt sure how much you paid for the phone but if it is less than $40.00 you might have to chalk this up to experience.

Do you have the classifed add?
If so keep it, you are going to need it.

Go to GOODWILL or the salvation army and buy a purse.
Make sure that the phone is charged and put it in the purse
Then take the purse with the phone inside of it to the crappiest part of town in your city (the ghetto or a trailer park)
PREFERABLY the GHETTO! (dare her to go down there trying to find it)
drop it off there on a corner there.
SERIOUSLY!
Someone will *'find'* the purse and
they will use that phone to call EVERYONE and their mother.

Then she wont have a choice but to cancel it because her phone bill will be $800.00 or so bucks!

If she somehow finds you 'say what phone?'

remember you told the guy on 3 way you didnt sell a phone',

say "I thought you gave that phone away because I called you about it and you told me you couldnt cancel the phone without paying a cancelation fee"....

Sure it wont get you your money back but it will COST her way more than it would have cost you!

She will be responsible for paying the bill and/or canceling the phone.

Will have served that bytch right for being so mean and selling you the phone that you can use in the first place.
REVENGE IS SWEET!

You only have 4 options. First option , ask her for your money back and give her the phone back. Second option , call the police and or prosecuting attorney and report her for fraud. Third option , take her to small claims court. And the fourth option would be to just take the lose and trash the phone. Do not make calls from it unless you have a receipt for it and can prove that you bought the phone from the owner but if you have all that go on and use it they would not be able to do anything about the calls. It sounds like she is either trying to set you up for something or she had no right to sell the phone to you.

DID YOUR GIRLFRIEND GET A RECEIPT FOR THE PHONE? IF SHE DID, GET A HOLD OF THE SELLER AND TELL HER YOU WANT HER MONEY BACK. OTHERWISE TAKE HER TO COURT OVER THE COST OF THE PHONE. IF SHE DIDN'T GET A RECIEPT, THEN YOU ARE GOING TO HAVE A PROBLEM. THAT IS RETARDED THAT SHE TOLD VERIZON SHE DIDN'T SELL IT....IF THEY WOULD HAVE CHECKED THE SERIAL NUMBERS AND THAT, IT WOULD COME UP ON YOUR ACCOUNT. HER DENYING SELLING IT TO YOU PRETTY MUCH HINTED TO THEM THAT IT WAS STOLEN. I WOULD CALL HER UP AND TELL HER THAT SINCE YOU CAN'T USE THE PHONE AND SHE'S NOT GOING TO CANCEL SO YOU CAN USE IT, YOU WANT YOUR MONEY BACK. AND IF SHE DOESN'T GIVE IT BACK TO YOU, YOU ARE GOING TO HAUL HER TO COURT TO GET THE MONEY BACK. YOU COULD TRY CALLING THE COPS, BUT I DON'T KNOW THAT THEY WILL TELL YOU ANYTHING. CALL VERIZON AND TELL THEM YOU FOUND A PHONE AND WANT TO RETURN IT TO THE OWNER, AND ASK WHERE TO TAKE IT TO. THEN YOU'LL FIND OUT WHERE SHE LIVES. YOU SHOULD OF TRIED EBAY. AT LEAST IF YOU WOULD HAVE HAD AN ISSUE WITH THE PHONE YOU COULD REPORT IT TO EBAY AND GET IT TAKEN CARE OF.

"hang up now." That is what you do. Then contact your cell phone carrier and complain about the calls. Give your carrier the phone number of the people who continue to call you. Put their number in your phone as SCAM for the name. When you see that on your caller ID, hit the disconnect key.

sounds like you were dupped. Either sale the phone back or suck it up as a loss. As long as you don't have a contract with her saying that you were going to take over her contract with verizon you should have no legal obligations, and as long as Verizon doesn't think you're taking over her contract, you might want to make sure they know you're NOT taking over her contract and have no desire to ever do so.
