Clearly 4. Roosevelt's controversial (and unpopular) response was his plan to "pack the court." Since the Contitution does not specify any particular number of justices on the Supreme Court, the nine it has always had is not a mandate but a tradition. Roosevelt contemplated (and floated a plan to) nominate additional justices. By adding jurists favorable to his New Deal plans, he thought, he might change the Court's majority and thus its rulings. It was quickly noticed that this could lead to the situation of each President whose party had a majority in the Senate adding justices to achieve political ends. The concept of a Supreme Court turned into a tool of the President and his party, as well as a Court of some huge and unwieldy number of Justices, was widely criticized. As a result, the attempt actually weakened FDR's presidency.
