How are people prosecuted once they are charged with alien smuggling?

they are charged with racketeering, breach of immigration laws , human trafficking.All really naughty charges. Ironically the illegal immigrants don't get charged as severely, go figure.

Do you mean illegal alien smuggling (as in illegal immigrants)? I would think that they are taken to court, and charged there. Why?
