Adam Gadahn is the first American to be charged with treason sinse WWII. He is facing the charges for providing material aid to terrorists.
Only a few dozen people have ever been charged with treason in the US, and very few convicted. The standards of proof are pretty high. It is the only crime specifically defined in the Constitution.
"Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court. The Congress shall have power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted."

Soem good examples can be drawn from U.S. civilians actually convicted of treason:
John Brown, convicted of treason for leading a raid on a government armory at Harper's Ferry.
Iva Toguri D'Aquino, aka "Tokyo Rose", for providing aid and comfort to the enemy for her propaganda broadcasts on behalf of Japan during WWII.
Mildred Gillars, "Axis Sally", for the same on behalf of Germany.
Hans Max Haupt, convicted of treason and sentenced to life in prison for aiding his son who was a spy for Germany during WWII.

Spying for foreign governments will do it every time. Johnathan Pollard has been in jail ever since the Carter administration, and he didn't even sell us out to the Russians. He was working for lsrael, who is supposedly one of our allies. Nevertheless, he's still in jail 30 years later with no chance of getting out. He'd have done less time if he'd killed somebody.
