Can you file a lawsuit? Sure, anyone can file a lawsuit against anyone for any reason. The real question is, will you win? The short answer is probably no. What law do you think they broke? The certainly owe you an apology and you should complain to their headquarters, but in court you really don't have much of a case.

Its possible. Go talk to the manager and see if they offer something. If they don't, talk to a lawyer -but ONLY hire a lawyer if they will only charge you if you get something out of it.
You may have trouble finding a lawyer though for such a small amount. Try the small claims court, where you can file for yourself without a lawyer. Be 100% honest about what was in the purse, or it can blow up in numerous ways (including losing the case and criminal charges).

A claim of negligence (which is probably the tort you're considering) requires 4 elements to be satisfied before you, as a plaintiff, can recover. 1) duty (on the part of tjmaxx); 2) breach; 3) causation; and 4) damages. Although you do have quantifiable damages, it would be hard to show that tjmaxx owed each customer a duty to safeguard their belongings. Thus, you probably can't sue.

It's unfortunate, but you've only lost your $250 watch and some time to replace the cards. Ultimately if you hadn't left your purse in the store you wouldn't have this problem, would you?

because it really is a civil lawsuit, i ask your self precisely what variety of damages he's searching for. If his eyes were completely scarred by potential of your alleged sexiness, then he's likely in search of someone to positioned a leash on him for walks interior the park and different kinky forays ! you may want to desire a lawyer experienced in BDSM... which make take a even as looking. you may want to attempt Craig's record ! As for being "completely frivolous", you may want to pick to get a reflect and dress up like Dorothy again... i imagine that fact is genuinely without advantage !!! i might want to for sure, be prepared to change places such as your neighbor if he might want to quite watch the fall canine that parade round my little coastline city after the summer time... the view might want to look more effective to his/her liking and can want to contain a lot less frivolous courtroom circumstances !

you can not sue them bc they are not responsible for the things left in the dressing rooms or the store they put the signs up there but you can sue the person you claimed it was there perse. They are not going to say they are sorry bc that would be claiming they did something wrong and they fear suite but again you can not really sue them bc of the sign im sure they have up saying they are not liable for things left in the store.

It sounds like you definitely need to speak to an attorney to determine your rights in this case. The attorney can investigate it, get the police report etc and tell you how to proceed. Good luck.

You can try but I do not see it going too far.
TJ Maxx did not lose your purse. They were not responsible for it or its contents. They thought they found the owner of the purse and gave it back.

Call a lawyer and give him the details and see if they think you have a justifiable case.
