UK pharmacists can export a % of their stock quite legally. I need to buy from Italian pharmacissts where prices are chepaer and sell them in the UK. Is is legal for the Italians to export? Where can I go to get more information on what pharmacies there are in Italy?

From a document issued by the European Commission in 2003 (COM/2003/0839):

"Parellel importation of a medicinal product is a lawful form of trade within the Internal Market based on Article 28 of the EC Treaty and subject to the derogations provied by Article 30 of the EC Treaty.

Parallel trade is a lawful form of trade between Member States of the European Union. It is known as 'parallel' to the extent that it takes place outside and in parallel with the distribution network that the manufacturers or original suppliers have established for their products at a Member State, while it concerns products that are in every respect similar to the ones marketed by the distribution networks.

In the pharmaceutical sector, it benefits from price divergence as Member States set or control by other means the price of medicinal products sold within their respective markets. The European Court of Justice has repeatedly confirmed that medicinal products are not exempted from the rules of the Internal Market and has condemned State measures which restrict, without appropriate justification, parallel imports of medicines."

Regarding Italy in particular, I have given links to Federfarma (national federation of pharmacists in Italy) and three other Italian pharmacy web sites. Unfortunately, all of these sites are entirely in Italian language, but even if you can't read these, you may be able to find contacts who may help you.

Are you a pharmacist? If so your professional body should be able to advise you on the legalities and probably point you in the right direction for overseas contacts if your idea is permissible. Generally there are no import/ export restrictions within the EU however medicines may well be a special case.

If you are not a pharmacist then selling pharmaceuticals is illegal if they are controlled substances and/ or listed under the Medicines Act 1968. Penalties vary with the drug concerned however you can safely assume the Courts will treat you in a similar manner to any other drug dealer - don't take this as a criticism, just honesty.

See "Erowid.org" for more info on pharmaceuticals/ law etc - don't take info from site as "Gospel" though - it is a "dot org" site BUT this does NOT mean the info is definitely correct.

Get in touch with your trading standards office. If this is the case that they are designed for the American market then they should not be given as a freebie by a UK mobile phone company. It could have caused serious consequences with the diferent current that the UK uses compared to the US. Its dangerous. Ring them today. Your local townhall can tell you their number.
