I had missed my turn for warehouse entrance, so decided to turn into another warehouse entrance to get turned. I had stopped and was going to reverse out onto main road, i put my car in reverse and was about to go, after checking it was clear to do so, then the other driving slammed into me. i thought that i was at fault for stopping and about to go into reverse at this junction (entrance). However he said sorry thought you were turning in? Can you clear up for me anyone?
Thanks

If you reversed onto a main road that the car was driving down then it will be your fault. Usually when someone hits the back of you it's their fault regardless - but not when you're reversing!

It is illegal to reverse unto a main road. My friend had the same problem and she was told by the insurance company that it was her fault. Had she drove unto the main road that would have been a different issue.
She was also motionless, but the fact that the reverse lights were on indicated what she was about to do i.e. reverse onto main road.

I had a similar situation where I was backing onto a main street. I looked at oncoming traffic and a guy made a left turn into where I was backing out. He did not use a blinker and I was still found at fault. Your insurance person should be able to tell you more.

Just because someone is sorry for hitting you does not make them at fault. Just a good person.

It is a road traffic offence to reverse onto a main road, you are at fault.
Assuming that is that you said you were reversing, if you say you had just turned in and stopped then the other driver may be liable.

Executing a Y-turn on a road is perfectly legal but, and this is bad for you, backing into traffic is illegal.
The other driver, by running into you shows that he did not have sufficient control of his vehicle. Both by inattentive driving and not attempting to avoid a collision.
You have, what is called by the insurance companies, is a double-fault accident.

If you weren't moving in the reverse direction and just stationary, then it's the other driver's fault.

In most cases if you are hit from behind it is the person who hit from behind fault. For all she knows, you could have stalled, in any case she wasn't looking where she was going. It's up to her (the person behind) to be aware of what is going on in front of them.

I would definitely decide whether you were moving backward or not.

Usually, if someone hits you in the rear, they are at fault. And I get really angry at people who try to speed behind me when I am backing out of a parking space because they shoud realize it is hard for me to see them.

But I know in some places it is against the law to back onto a main street. So local law may dictate fault in your area.

The guy said he saw you and decided to drive into you, hoping you'd move. His fault, absolutely.

If someone crashes into you from behind and you are not moving, then it is pretty much seen to be automatically their fault.

If you had started to reverse into the road, then there might be some doubt.

if he hit the back of you it was technically his fault for not stopping. But if you know it was your fault, do the right thing, or call him and agree to pay for your own damage. There are too many people out there for the money. If you are fine and can afford it, and it was yourfault for stopping right away, pay for it yourself, dont make someone else.
