contact the Department of Labor........but realize that all parties involved or having knowledege of this could be in a little trouble, the employer and the employee, and the business itself.

I guess I'd want to know why you want to get someone in "trouble"? Many small businesses can't always offer jobs that fulfill all of the requirements of government regulations; or perhaps they only have occcasional needs.

Do you feel that someone is being abused or that someone lost a job to someone that is being paid in an illegal fashion?

If that is the case then you might start with the Better Business Bureau. They can point you at the right agency. They might also consider contacting the firm and seeing if the problem can be fixed without government intervention
