My ex wants to visit the kids this weekend. Can he stay at the flat with his wife and kids and I leave for the weekend. Do I have the right to let him stay if I am not supposed to be there anymore ?

Even if your lease has expired, if you continue to be in occupation of the property, what is known as a holdover tenancy (operating on a month-to-month basis) is created until a new lease is signed. Pls. note that during the holdover period, a landlord can charge upto 200% of the rent due under the old lease so it is in your best interest to sign a new lease.

If you're not there and the lease has expired and you have a really crummy landlord, somebody can be charged with trespassing. Pay the rent that is due so that you don't wind up with an enforceable judgement against yourself that gets attached to your credit report, making it difficult, if not impossible, to get a lease with another landlord.

You have no right to stay unless you have paid. Expect to be evicted in 7 days (depends on what State you live in)
