We have a water main that runs through our garden that appears to have burst. As a homeowner (and not a council tenant) is it our own responsibility/expense to fix it, or are the local council responsible for this? We live in East Ayrshire.

As a house-holder, your responsibility starts at the water meter or stop-tap on the pipe that supplies your property. If there is a leak on your side of that point, its up to you to fix leaks, but on the other side, its the responsibility of the water supply company. If the water pipe is just passing through your property to supply some-one else, get hold of the water supply company to fix it - and repair the damage. Their emergency number should be in the phone book.

This happened to me. Because the water main supply was to my property and the leak was on my property and not outside my property boundary i was deemed responsible for the payment of the repair. The cause of the leak was a tree root which took me three days to dig out and clear so that i could fix it myself. This option was better than paying what the water company were asking for them to do it.

The water company is responsible for a water pipe up to the point where it is on your land. If it is on your land you are responsible from there on. But in saying that, different water suppliers have different rules as regards pipes through gardens. I think it is worth checking with your supplier to make certain if its a job for them or for you.

If it's nothing to do with you (i.e. not your supply pipe, but just passing through) it's not your responsibilty. It'll either be your local authority or the water company.
