While involved in an argument with my ex-girlfriend she tried to stop me from placing her belongings out on the porch. While doing so, she attacked me by grabbing my hand and kicking me in the knee. She proceeded to go next door and the neighbors called the police. I did not hit her or threaten her in any way. I was arrested for assult.

She obviously lied and the scratch appears to be an accident. If you were tossing her out, that's the only reason she called the police...to get you out so she could stay.

Here's what you do. Get yourself an attorney and tell him the absolute truth and withhold nothing. (That's withholding evidence) Tell him WHY you wanted her to leave and that you were putting her luggage on the porch and what she did.

Then, ask him if he can get a 'restraining order' from the judge so that she cannot come within 500 feet of you or your home. If you do this, it will show them you are very serious about not wanting her there and that she's been behaving abusively. AND that what happened to her was an accident. She shouldn't have tried to stop you, but apparently she needed a place to stay.

Women like that are not in love, but they USE and they keep on doing it...just like some men who hit women or beat on them; they can't stop without help. Perhaps since she had no where else to go, this should tell you something about her amassed friendships. Maybe no one else wants her there either.

Once the attorney gets the restraining order, do not accept any phone-calls from her either. This will only taint your case. If you have to, change your number. It would be a good idea.

BTW, voice tapes unless it's a recorded phonecall are not admissible in court in some states.

Boy!! did you get a bad deal. Just touching some one very lightly with your finger , can be considered assault. In other words, she went and lied to the neighbors , and you were arrested. Figures and I believe you. Bad thing is, Neighbors and Police believed her, now you have to defend yourself in court. If you have contact with her, be nice, get her to tell you why she lied, keep the tape recorder rolling. If she admits it, case dismissed, then sue her as*.

In California both, the man and woman get arrested, unless it is blatent abuse on one parties side.
