When people post on the board about an MIP it seams that people take that as a DUI. Is it the the same charge? I think the sentencing is much different. I am going to talk to my lawyer tommorrow because I got my second MIP at a party. I violated my probation so I am not sure how serious it is. Any one been in this situation? Thoughts? Also, don't tell me that I have a problem, I just have really bad luck.

You didn't mention what state you are in when you were charged with being a Minor In Possession (MIP) of alcohol. It varies from one state to another.

But, for example, in my state, it is almost the same as a DUI (Driving Under the Influence), because a minor who is convicted of being in possession of alcohol (EVEN IF HE IS NOT DRIVING A CAR...EVEN IF HE IS AT A PARTY), can have his driver's license suspended for a year .

Minor In Possession, commonly referred to as “MIP”, occurs when somebody under the age of 21 is
caught possessing alcohol in a public place. The official charge is a violation of Business and
Professions Code section 25662(a). The most common location for these violations are beaches,
college campuses, and places celebrating public holidays such as July the 4th or Cinco de Mayo.

MIPs can be charged as either infractions or misdemeanors and those convicted of MIPs will often pay
fines and/or are required to complete some kind of community service that is associated with a alcohol or
drug treatment program. The most devastating penalty, though, is that one’s driver’s license is
suspended for a year.

Your driving record will show that you had your driver's license suspended for an alcohol-related offense. This might have some serious consequences regarding applications for employment, and for your insurance rates.
'Yes, you should check with your lawyer if you are currently on probation for a prior conviction. It may be difficult to get lenient treatment and consideration for a second offense.

DUI is driving under the influence of alcohol. MIP is minor in possession. Usually MIP tickets are giving to minors who have alcohol at a party and are NOT driving a vehicle. DUI are obviously given to people driving in autos who have been drinking. If you were on probation and got a 2nd MIP ticket, the Judge is not going to be happy.

Well what does MIP stand for? And yes you are going to jail now, violating probation, way to go!
