Things I should have thought to tell you... This rape happened a little over a year ago. I didn't go to the police. I was too hurt to get out of bed for two days. (Saying it was a puddle was no exaggeration.). He refused to take me. I was hurt and scared and ashamed... I didn't know what to do. So, no there is no paper trail. Not with the police anyway. I'm still having gynecological issues but I don't know how I could prove he caused that either. I know I should have filed a report. But I didn't. If anybody has been in a similar situation, please contact me. I have got to get out of here. And he's not cooperating.

Check out the laws and statutes of limitations in your area, you might still be able to bring charges against him.
Nana, I hope like all that is Holy and dear to you that you never, ever, EVER get into a spousal rape situation. I don't care if the people are married or not, if one says no, the farkin' answer is NO, and if someone has sex with someone else after they've said NO, then it is rape, plain and simple. Oh, and if you ever are called to jury duty for a spousal rape case, you had better tell them your views on it so that the victim can get proper justice for the crime committed against them.

You should get yourself down to the local law enforcement office in your area and file a criminal complaint against him and pick up a restraining order as well. Being married does not make him immune to the law. Rape is Rape. He certainly wasn't "Making Love" to you. He did it out of hatred and to show his dominance over you. He's sick and could rape someone he's NOT married to.
Added: You are still within the statute's of limitation for this crime. Regardless of whether the DA takes it to indictment, you will still put it on record so if and when he rapes someone else, it will be there to help convict him.

I'm sorry that happened to you. That is never right. Ever. Rape is a about dominance and control. You are right to get away from him.
Yes you can use it in court. It will be his word against yours unless you have a police report filed and hopefully hospital records. It is easier to back up your case with verifiable proof. Much harder with no paper. Good Luck

I think that you could use it against him in court...just consult with an attorney and you should get a good bit of advice....
I am sorry that happened to you...
I believe that you reserve the right to say no... regardless....
even if he cleaned up when he got done...you didn't deserve to be hurt spiritually emotionally or physically like that....
But, if I were you I would get some counseling...and have that report written up in your defense as well...

I was raped while in a lesbian relationship and it wasn't reported until 6 months later. She admitted to everything and was charged with 2 counts of second degree sexual assault and one count of third degree sexual assault. I doubt he will admit to what he did to you but I still think that you would be able to use it in court if you decide to go through with a divorce. I don't think without a confession from him he can get charged with anything, though.

Brutality is never acceptable behavior, whether it be for sex or anything else. You need to get out of the house if he is beating up on you while you are still alive.
As for spousal rape, I do not believe that there should be such a thing, since sexual intercourse is a part of marriage, and if you do not accept this, then you should not be married to him or anyone else for that matter. If you do not wish to have sex with someone, you need to make that clear them and don't get married to them in the first place.
If I were on a jury, I could not find a spouce guilty of rape under any circumstances, but sounds like he is guilty of assault. If he is physically abusing you, which it does sound like, that is grounds for divorce. If you insist on staying with him, I do not believe you have a right to continually say NO to him.

if theres no report you're going to have a hard time proving it. Sorry but thats reality.
They will see you as vindictive, all I can say is get a really good lawyer. I dont generally believe in divorce but it sounds like you need to break away, good luck

if my woman would threaten me with any charges of rape, then its over between us, but then again what you describe that you went through i guess it would be rape or at least asault and battery, and you should have made a report on it as soon as you could have
you should have dialed 911 and gotten some emergency crew over to your house to pick you up or something
