He had a good job, but after 1 month of child support quit. We go back in for a permenant custody hearing in a few weeks, and they are going to review his hours before that, which will show up that he's making nothing. If I now know where he's working should I say something even though his hours are cut, or wait until he thinks he's secure (picks up more hours) and then do something... Basically, what I want to know is "what do I do about him trying to screw my kids over on child support?" Thanks, I'm so frustrated! grr.

If the court see's he's not earning anything, he still must pay the minimum for each of the children. Atleast get the minimum started and after he thinks he's gotten over on you and the courts, and feeling all nice an comfy, he'll let his guard down and start earning where his earnings are reported.

Then you can go back to court and get an increase in child-support. However, If you have a good attorney, your attorney could approach his current employer and threaten legal action if the employer doesn't come clean. He could even threaten to file criminal fraud charges against the employer and the ex.

You have lots of options. but atleast get the childsupport ordered by the courts even if it is just the minimum amount. The various states have the ability to go retro-active if proof turns up that he was making more money than information was available for at time of child-support order creation.

He can get in big trouble for not reporting the income to unemployment. As far as child support you need to prove he is doing this and how much he is making and whether it is steady income or not.

The courts will use a baseline income if he does not present documents showing what he currently earns. They base this amount not just on minimum wage...but also on his earning potential ( i.e. someone with a college degree will have a higher income asessment then someone without ) You should definitely divulge any info you have about his income....just make sure it is accurate info !

It doesn't matter if he making anything, he still has to pay his fair share. I say go after him now and remind him the money is to help pay for the kids. Many women i know wait then before the know it years have passed. And the losers are the kids. If you love your kids, then fight for them. Get the $$$.

its easy he works under the table so he dont have to pay you. you will never prove he dont. i work in construction. if the cops arent out on a jobs at least once a week busting the deadbeat dads there is something wrong. he needs to take care of his kids but the courts dont think about his needs. and you probably dont eather right. i have no kids i was married 12 years. if i did i would have to pay about 1200 a month. i know this cause i have a buddy that pays the same we are both in the navy

well the honor system doesnt work, thats been proven. they passed all of these laws because of how deadbeats work under the table just to screw their own kids.

they should calculate a minimum wage at least or you could request that they review his tax returns for an income amount.

even if he isn't working he still has to pay child support. they can base it on minnimum wage if nothing else.
if you don't stick up for you and your kids who will!!!!!!!!!!!!!!!!!!!!!!
