I took a picture of a Ferrari 360 Modena without the owner's consent with me next to it, imitating the the driver. Is that ok?

So long as you weren't *touching* the car without the owner's permission, I doubt they'd have a problem with it. Exotic car owners, on the whole, like the response their cars draw from people on the street. They don't mind picture takers at all, or even having people next to their cars--so long as they're respectful.

If it was in a public area, then it's image is there for you to take. And even here, the only entity that could have a problem with you taking a picture like this would be the company Ferrari, and not the owner of the individual car (since it is the company that own the rights to the shape, design, and image of the car). This would only come into play if you were to use the picture to promote something in such a way that it could be considered to somehow be part of Ferrari, or endorsed by Ferrari. None of which sounds likely in this case.

The only other case would be if the car was not visible from public space and that you had to trespass in order to take the picture. Though this would be illegal based on the property issues, not the picture of the car.

Legal issues aside, there is the question of is this something the owner would be upset about? Probably not. Most Ferrari owners, or owners of any exotic cars, understand the car's appeal very well. Many also may have spent much of their lives wanting one... as such, they will be very protective and not want you brushing up against the car or anything like that. But most will be accomodating of pictures like this if asked (and wouldn't mind if it happens when they aren't around).

Some may, but most would probably just find it a nice compliment to their car.

Do people often ask these questions over and over again? Don't do it...it's sick! If you like her, talk to her...if you want to take her photo, ask for her permission. I'm sure she'll say NO, but still...it's the right thing to do. Stalking someone IS illegal, so if you are chasing her with your IPhone in order to collect pictures or videos of her, that could technically be seen as stalking, and you could be in trouble! So seriously, give it a rest, and quit asking this question!
