Whether you have proof of his divorce or not does not stop you from getting your license.You do not need his divorce decree to get married.Some how I feel there is something a foot.If I were you,I would make sure he is truly divorced.Something tells me his divorce never went through.I will tell you why.A divorce is a matter of public record.All you need is a Phone call to get that record.

Don't know the rules for your state, but in my state, it depends on how long ago the divorce was finalized.
"If you have been married before, you will need to know the specific date your last marriage ended, and how it ended (Death, Dissolution, Divorce or Nullity). Some counties may require a copy of the final judgment if your previous marriage ended by dissolution or nullity."
SOME counties do, some don't. Ask, or look up the requirements on the web
