ok I want to know if I can file my husbands tax return...but he is in jail ..also i wanted to know if he writes a letter stating that he wants me to file it for him and he sends his signature in the letter...will they let me file it for him... i have his last name... please help!

Do it yourself online (efile) you don't need his signature for that, and you don't need him to be there (as long as he knows you are doing it for him) you only need his w-2

A letter with your husbands signature is not sufficient.

You need a "power of attorney" to sign taxes for your husband. You can get a standard Power of Attorney from a Notary Public or a Paralegal. Or you can use Form 2848 from IRS.gov. It must be notarized. There is probably a notary at the jail; if not you will have to pay one to accompany you to the jail.

You will need a power of attorney to do so. Another option is get the return prepared (or prepare it yourself) and bring it to him to sign. I mean, if he can write/sign a letter, he could just as well sign the complete return.

If he is your husband, you can file for him. File a joint return and sign his name. Unless your state prohibits this from being done (I'm not sure where you live) there should be no problem. My husband is in the military and when he was deployed I signed our tax return with both names and I never had an issue.
