I'm not sure about your state, but in Florida, I have been told that all hair must be under a net or hat. I've seen hair stick out of both, so I guess that one is up to the mood of your inspector.

Technically my inspector was supposed to visit once a year. It was usually between every 9 and 18 months because they were understaffed. I always passed with flying colors. In fact the inspector told me that that's why he didn't need to come around that often, because everything was always excellent.
As far as the ponytail, I'd definitely have a head cover. I used to have short hair which wasn't a problem. Now that I have a ponytail I wouldn't dare cook for the public without a cover. I'd tuck it all up under a ball cap. When I cook at home I see my own hairs drop onto the stove. I wouldn't risk having anyone find that in their dish.

I've been in the restaurant business for many years. The inspectors come whenever they want, usually 2 times a year. I've been working 4 a private club 4 the last 15 years and I've never seen a health inspector. My kitchen is the cleanest in town due to my strict demands. If and whenever they visit my kitchen, they will set new demands for public restaurants.

You never know. Usually once a year, but they could dress up like a customer and secretly investigate. As long as your hair isn't fried you can keep it in a ponytail. Fried hair falls out easily.

The health department come and goes when they want to.They don't let anybody know it will blow there cover.Yes you do have to have you hair up in the hat at all time.If not in a hat,In a hair net.
