My wife's daughter only stays with us on the weekends and when she has breaks from school. Her father went to Turkey for the Army and he will be there at least 6-9 months. Can my wife and I move her daughter in with us while he is gone? We don't want her to stay with her step-mom.

The parent who has custody makes the decision about the child. If he and his current wife care for the daughter then it is reasonable for him to leave his daughter with the ongoing care of the step mother. Unless you can prove she is mistreating the child there is not much you can do. Have you tried talking to him and her and seeing if you can arrange to have the child more often during the father's absence

Yes, you are the other parent. The step-mom has no right to the child. If The father is gone, she should be staying with you, not the step-mom.

my first question is why wouldnt dad want her to stay with her mother while he was gone in the first place...
I would talk to your lawyer...each state has different guidelines they set with regards to that...
but you would think that yes, mom should have placement and custody....for the child since dad cant....
