It depends on a few things... How big is the company? If they are big enough, they have to give FMLA leave to employees who have been there for a set amount of time. If you've been there for the set amount of time (I believe it is a year) and they are big enough, then you have 12 weeks of unpaid leave that you can take and they have to hold your job. Otherwise, they are not obligated to hold your job.

This is a sticky question. Depending on how long you have been with the company yes they can fire you. But there is a medical and family leave act but like I said I think you have to have been on the job full-time for a year, and the company has to have more then a certain number of employees as well. Check with you local employment agency and ask them, they will be more informed on this subject. I hope that you don't get fires because that would just be inhumane to do to a pregnant lady that is already suffering from being put on bed rest. Good Luck and God Bless you and the baby.

I basically responded your different question, and it kinda angers me that persons will initiate spouting off all of those issues that they don't have any clue about. in case you do not paintings for a organization that has a minimum of 50 workers or you've not worked there for no less than 3 hundred and sixty 5 days they could fireplace you for occurring medical go away because you do not qualify for FMLA. on your previous submit you suggested that you in trouble-free terms worked there 10 months, so that they did have the legal actual to hearth you and also you are able to not sue. you are able to also not assemble unemployment because you're not any further bodily waiting to paintings. regrettably there is not any longer some thing you need to do about it. i understand precisely the way you experience, as i have not been waiting to paintings considering 31wks and my expenses are commencing to get very behind. I did a ton of learn and contacted some legal professionals and were given this similar answer everywhere I grew to grow to be. i'm sorry that you worked for some jerks. Like I suggested, i understand the feeling. I desire you the finest of success and congrats on the child. To me my son is wisely worth each and each and every of the debt in the international, and that i'm particular you'll imagine an similar in some weeks!

Depends. Do they fall under a company that is covered by FMLA? If so, than no they cant. If not then then yes they can. Most companies that fall under FMLA have 50 or more employees. Small buisness' are the usually the ones not covered by it. They reason they could state is that they needed to fill your position and its completely legal. Just like those companies that arent covered under FMLA can fire a women once they have a child and cant go back to work for a certain number of weeks. It doesnt seem fair, I know, but its legal.

Many people think Family Medical Leave Act applies to all buisness', it does NOT!!!!

It all depends on what the workplace legislation states where you are.

If you have a doctor's certificate stating you have to have complete bed rest that should be enough for you boss, but as I said it all depends on your rights at work as stated in your contract. You would have a pretty nasty boss if they were to fire you because of this, and if they did is that someone you would really want to work for???

I had an experience sort of like this, everything was all set and my maternity leave had been approved when there was a change in management, my new boss told me that I wasn't entitled to any leave and told me I couldn't have it. He was so rude that he called me at the hospital the day after I gave birth (a Wednesday) to my son to tell me that if I didn't come to work the next Monday not to bother coming back. So right there and then I quit, if that was how he was going to treat me a day after giving birth, I didn't even want to think of what things would be like if I went back.

no if you have a doctors notice that you are put on bedrest for the rest of your pregnancy.. you can NOT be fired for that. You just have to make sure they get a copy and if they do try you can sue and show any court and judge your notice.... but they can not fire you under that reason.

There are Federal laws protecting pregnant women from being let-go in situations like yours. I suppose they could fire you but if they do, find you a good attorney ASAP, because you will own the company in the end!! Good luck to you.

If your pregnant and your doctor says bedrest for a certain length of time you need only turn in the doctors order in writing to HR.
There are federal laws that protect you while you are pregnant and you can draw disability during that time too.

I should hope not!!! If you have a genuine medical reason for being on bedrest, of course, they shouldn't be able to fire you. You could sue them for unfair dismissal if they do.
