I'm married and my new husband pays support for 3 children form two different mothers. One of the moms who has 1 child wants more money because he is married to me. I have 2 children of my own and i support my kids. Can my income be used to increase the child support he is paying for?

NO! Each parent is only responsible for their own children. You are not responsible to support his kids, nor is he responsbile to spport yours. If either of you are behind in support they can and will intercept your tax returns to pay those balances off. When you file your taxes also file and 'injured spouse' form so neither of you have your portion of the refund taken for the other's debt.

Also need to add that the courts will NOT reduce his prior obligations for support because he has taken on a 'new' obligation or has more children--as one poster above has stated. If that were the case there would be a lot of non custodial parents coming back to court stating they just bought a new ( house, car, condo etc) and now I need my support lowered.............ain't happening!

Nope. His income and only his is used for calculating support payments. In fact, since he is now remarried, that needs to be taken into account and the support can sometimes be reduced due to his new obligations to you. Ultimately, in California, the amount of payments is figured by the state and cannot be adjusted by either party.

no only his income can be used to determine amount.they will also take into consideration his other children he pays for but not your two unless he is their biological children

yes if the exs want to be nasty. That is what my lawyer told me, but don't tell them what u make. Tell ur hubby to go to court and fight it. tell him NOT to mention ur name. What biotches!!!
