Bringing an action and succeeding are two different things, there are number of policy reasons why claims cannot succeed, people are talking about rights, the bottomline is in most cases these actions fail, because of the flood gates argument, it will eat into treasury funds, there are no human rights when will people realise that generally public interests on the whole and the government financial interest in its revenue earners (tax payers is more important than the individual rights) , if people bothered to actually read the european jurisprudence you will come across the public policy argument prevailing time and time again.

The government is largely made up of lawyers, and the political establishment is underpinned by a large legal contingent. The sue-claim culture has been highly lucrative to the legal profession. there are so many loopholes. Don't forget Cherie is a "human rights lawyer," and it is big business for these people to make money out of human rights legislation. The government don;t mind losing because it is not they who pay, but us.
