He could sue for divorce on grounds of adultry. Yes, it can be used against you. The lawyer should have told you that.

You just never know in a divorce. The best bet is to hold off dating until the divorce is final in a month.

Most likely he couldn't. Most states are community property states anyway and that wouldn't effect your division of assets, just potential custody arrangements.
I'm not a lawyer though and the laws are different from state to state so take it however you will...

IT MAY DEPEND IN WHICH STATE YOU LIVE. CALL A LAWYER OR LEGAL HOT LINE AND ASK THEM.! IT WOULDNT SEEM THAT JUST DATING WOULD MATTER OR HAVING A FRIEND BUT BEST TO MAKE IT LEGAL WHATEVER IT IS.
