I'm traveling from NY to Niagara Falls (Canadian side) and I just heard that the new passport law doesn't start until January 2008, and so I just need a copy of my birth certificate for now. Is that true?

Your understanding is mostly right except the date. The EARLIEST you need a passport to drive to and from Canada is January 2008. The implementation date is not firmly set, it depends on if they are ready. IT can be 12 to 18 months.

You need a drivers license and birth certificate. A drivers license to prove identity, and a birth certificate to prove citizenship. With the move toward passports, I wouldn't go with less than the 2 documents anymore. Too much hassle.

You don't need a passport to get into Canada if you're coming in by car. Yet.
In January of this year, it became law that a passport is required for all air travel between Canada and the US. Within the next year or year and a half, a passport will be required for all travel between Can and US.
For now a drivers licence is best. (Birthcertificate is OK.)

There are two issues associated with your travel, entry into Canada and return to the US. The requirements to enter Canada are spelled out on this web site (you need a passport or valid proof of who you are): http://www.cic.gc.ca/english/visit/index.html

Then for your return to the US you WILL BE REQUIRED to have a valid passport (since January 23, 2007). Check out the US passport site:

The only exception to having a passport is for the next 12 months only, you can go on a cruise out of a US port and return by that same ship to the US without a passport. If you are not a US citizen then other provisions may apply.

well, you'll need a valid drivers license. but yes. this year you can still act like a free american and cross the canadian border with only a birth certificate. actually, where you will need this is to re-enter the us.

Yes indeed. You need a passport to enter or leave the US to anywhere outside the US. New law.
