Actually, to clarify the answer, yes, we as gay people have the right to marry in NY as long as it's a member of the opposite sex. Same sex marriage is currently not permitted in NY but may very well change with the new administration.

To clarify a previous post, Eliot Spitzer, when he was AG, had to defend New York and the laws as they currently are but he does believe that we should have the rights, benefits and responsibilities of marriage. He has stated, I believe, that he will work towards changing this.

And he has stated that NYS will recognize ALL marriages that were entered into elsewhere. So if a gay or lesbian couple get married in Canada, for example, and then move to New York, that marriage will be recognized as a valid marriage in NY

No. The current Governor of New York, Elliot Spitzer prevented gay marriages while he was still the AG of that state.

And gays blame right wing Christians from being them the happiness they desire. Sorry, but Spitzer is the furthest thing from a republican since Karl Marx.

You can marry in Massachusetts if you desire, but you have to be a resident there first. And better hurry, since the Mass congress won't vote to keep gay marriages legal, the citizens are planning to overturn the courts. Shame Massachusetts wasn't a red state, then we could blame Bush.

You can get second class status in either Vermont or New Jersey, but that doesn't carry any status outside the state.

No, the case went to the Supreme Court last year and they voted against gay marriage, sadly. To the person above me, Eliot Spitzer was kinda forced to defend the law that the New York Legislature passed banning gay marriage as state attorney general; he supports full gay privileges. You can go to Massachusetts to marry, or you can go to Connecticut, Vermont, or New Jersey (starting Feb. 15th) and get a civil union (basically the same thing as marriage except the name of marriage), but you'd have to become a resident of that state and it wouldn't help you if you planned on moving out of the state, sorry.

No, it is not which is pretty sad. The right to enter into a state sponsored marriage contract should not be only for heterosexuals. Massachusetts allows marriage without discrimination based on orientation and Vermont, Connecticut and New Jersey allow for civil unions which allow all or most of the right and benefits of marriage without actually calling it marriage. Why bigot people get so worked up over the name "marriage" is beyond me.
