Like others have said, transvestites don't have both male and female organs; those are intersexed people ('hermaphrodite' is an old, antiquated term). Transvestites merely dress in as the opposite sex.

Intersexed individuals are invariably sent to to prison of the gender which they are presenting. Don't forget that a lot of intersexed people do not actually know they are intersexed (there are 'women' who are born with female genitalia, but actually have undescended testicles in their stomachs, for example), and so they continue to live their lives as whatever gender they were declared at birth, unless they find out and decide to change it. Even if they knew from the beginning that they were intersexed, they usually choose one sex or the other to present to the rest of the world, to declare on their driver's license and other official documents. That is the sex they are considered in the eyes of the law, and they will go into that prison.

The correct term is intersexed. Having both sets would be very unusual, doctors usually "surgically correct" it at birth, although this very often leads to the person being unhappy. If they have both sets of organs, at least one would be non-functioning, and they would almost certainly be infertile. I imagine they would either get sent to the female part or be isolated from the other prisoners, because the males would take an unusual amount of interest in the person I imagine.

First off, a transvestite is a "cross dresser" and doesn't have both parts.

A person who has both parts is called a "hemaphrodite"...and they don't care where they are sent because they diddle themselves to sleep every night!

Actually, to my knowledge, there are no humans with this condition. Some women are born with a very large clitoris, but not testicles. I see no reason to send someone to prision just because they have a large clitoris. To my knowledge, this is not a crime...of course, if some people have their way, it will be soon.
