You can get child support even if you were never married. If you are in Texas, contact the Office of the Attorney General. They can help you.

Normaly yes.. the court will order a preliminary order for child support, and other things, at the beginning of the seperation/divorce proceedings.. until the divorce legal seperation is completed... but you will need some sort of court order.. if you have no court order.. there is nothing to enforce..
One does not have to file for divorce.. one can simply file for legal seperation (which usually leads to divorce by the other party 90% of the time in thier response.. due to NO Fault divorce laws)
You specifically mentioned divorce.. so i hit it from that angle.. Technically you dont have to be married at all to file for child support.. but thats slightly different.. but slightly the same.. You file for child support in family court (The court clerk has all the forms)

If you are seperated and not divorced and can come to an agreement with your soon to be ex hopefully you can work something out that will give you some kind of income to support your children until the divorce. If not, eventually he/she will have to pay any back support in the long run.

I know in Florida a person can get temporary support during a separation or during the pendency of an injunction. Of course single men that never married their baby's mother pay child support all the time. They taught us in law school - child support is the right of the child, not the parent. It cannot be waived.

This requires a court order - it doesn't matter if you are divorced or not. In Texas you better get an attorney - they are ruthless in that state, meaning not for the family...only for the money.

You can get child support if legally separated, if never married or if divorced. If still married to the father, no.

I think we need more detail. Do you mean seperated, but not divorced?
