Depending upon emotional maturity..and the parent's credibility....
I think that the child should be able to choose...
But, I think that the child should be told what thoughts to base their answer off of....I don't think they can make a logical decision without someone to mentor them through the process...
And, counseling may help them to cope with their decision....
Maybe they shouldn't have to look at it as a picking or choosing....but a trial basis....so that they don't feel bad about the situation...

In most, if not all, jurisdictions the court will listen to the children once they reach an age where the judge thinks the child knows what's going on. But in the final analysis the court will rule based on what the judge believes is in the best interest of the child. Most of the time the judge will take the child or children aside and talk to them out of the presence of parents or attorneys.

Actually, parents should be made to live close together in the same town until the children are 18 and the kids can go back and forth on their own choosing.

I think in most cases the kids are better off with the mother. I don't know if a child should be able to choose, I didn't get to choose who I lived with when my parents divorced and I think that is good because it is one more huge stresser for a child if they could. the children are already torn.

I think no. My son is 8 and we are going through a custody battle. He kept my child for about 1 month before we got into court. The judge ordered him to stay at his dads for now. The battle hasn't begun yet. My son tells me that he is scared to tell his dad he wants to live with me(he has lived with me almost all of his life except for the last 5months)cause his g-ma(his dads mom)will be mad at him. A child shouldn't have to make that decision. He shouldn't even be asked to choose. My son is a people pleaser. He don't want to hurt any ones feelings. But yet he is trapped. And right now I cant save him from being hurt. A child should be with their mother unless she abuses drugs. A child should never be taken from his life and never be put in the middle. Mothers are the one that takes on the responsibility most of the time, when no one wants it!

I think yes, depending on their age and their reasons for wanting to live with that particular parent. Also sometimes kids need to be able to make their own decisions and if it turns out to be a mistake than they have other options.

on some levels yes, it might be a good idea, but think about it being a kid, your parents split up, your loyalty is divided, and then you have to make this HUGE decision about who to live with, and no matter who you chose, the other one is going to be hurt....laying that type of burden on a child is really unfair.

this something u should really think about, girls should stay with mom because of all the attention and personal reasons boys should grow up witha father figure in growing up to b taught how to b a man and not to depend on mom
