My boss says that I should be in the office and ready to work by 9 on the dot - and that I should only put on my coat and pack up, etc AFTER five. This essentially adds 15 minutes onto my working day that I don't get paid for. Is this legal?

It depends on whether or not you are exempt or non-exempt, ie are you paid hourly or are your salaried.

Hourly employees should be paid for all time worked- however, in your example packing up, putting on your coat, etc is considered non-working time, since you are not doing any work. However, if you were still doing "work" after 5pm and not getting paid for it and you were on the clock, then yes, that would be illegal.

If you are paid on a salary, ie you receive the same wage regardless of the hours worked in a week then it is not illegal.

Honestly you have to ask yourself are you being fully productive every minute of your 9 - 5 work day. Most people end up wasting a certain amount of time during the day (extra long bathroom breaks, internet, long lunch, etc). Your boss has to pay you for this time as well, so it is not altogether unreasonable that your boss request you to be ready on the dot to work. I mean, should an employer have to pay for the commuting time as well?

Legal or not, is it ethical for you to even questions this? Hell, you got a job! DO your job and shut up. If you have to stay a little extra oh well. DON'T BITE THE HAND THAT FEEDS YOU!!! Like one answere said before. You don't work 9-5 non-stop. You take little breaks and stuff. I would see how you get mad if your boss wants you to stay an hour or so extra without offering extra pay. But don't cry about 15 minutes.

yes and no, just get your stuff ready slowly throughout the day for when it turns 5, then 20 of grabbing your final stuff and out the door, and get to work a couple minutes early, sit around and drink coffee or something, just so your there, and make sure your computer is on, then when your about to do some paperwork or something, when you need something thats in your bag from home, then just grab it outta your bag. ya don't have to do a full set up and take down for when you go to or leave work

i would say yes it is. if you are expected to be all ready and in the office by 9 am you have to be and same until 5 if you are needed by people or your boss, etc you must be in your seat. it's just some companies are more lenient or some bosses :)

It takes me 1 minute to get ready. It shouldn't take you 15 minutes.
