Usually, if your license is expired, it's expired. You're driving without a license. That's the same as if your license had legally been suspended for a violation of law. The difference, though, is usually in the penalty -- driving with an expired license is just a minor infraction, but driving with a suspended license results in a harsher penalty (sometimes people are arrested... sometimes the fines are much higher). The reason is that a suspended license requires some COURT or similar body's direct order. Before your license would be _suspended_, you have to get notice and an opportunity to be heard. Thus, if some court took away your license, and you were still driving, you are violating a court order maliciously. An expired license just means you're a dummy and you forgot. It wouldn't be "suspended," because there's been no court action revoking your license.

I don't know Kansas law, but in most places, once the license expires, it's no good. Some states have a grace period, but I'd say that after 2 years, you'll need to reapply.
Do this soon, as you are driving on an expired license. Which is illegal, everywhere.

No, it's not suspended. Suspensions only take place after you've broken the law in some way, and letting your driver's license expire is no crime. However, driving without a valid license IS a crime. You will probably have to take the written and road test again. You MIGHT be able to get out of it without taking the road test again, depending on your record.

as far as I know it can not be suspended. My husband (we live in N.C.) was just pulled in November and he had been driving on an expired license for over a year. They wrote him a citation, the next day he went and got his license renewed and when we went to court, they dismissed the case because he had his license. You need to get it taken care of quickly before you get pulled.

It can't be suspended since it technically doesn't exist. You will, at the very least, need to be retested (possible paper testing and driving test) to obtain a new license.
Go the DMV and take care of this asap.
