Been rentin the house for almost 5yrs, always payin full rent in proper time. They say they wanna renovate but cant do it while we are stayin there and have given us almost 3 mnths notice but we still havent found a reasonable sized place that we can afford. Points to note... They only got a contract to buy the place a yr after we moved in and payin rent to them. Even now the house is still registered in the name of the person they were buyin the house from. 5yrs later. The original owner (the seller) was not aware of them rentin out the house. Their lawyer had a letter hand delivered to us stating that we have to be out of the house before/on 31 Jan 2007 or else they will apply for an eviction notice. However, the letter was only delivered on the 6th Feb 2007, a full week after the due date. Can any lawyers give me advice? Oh and this is in South Africa, so UK and US law willl be different, although advice from those and other countries will also be accepted, even if they dont apply.

in America it is improper notice not to give 30 days written notice on a month to month lease but your story is full of holes. try again but with tax deductions you should be able to buy a house and build equity and pay about 400 dollars in mortgage less than you currently pay for rent...

If they will not willingly vacate, you need to give them an eviction notice. Just receiving mail at your place is enough to establish residency in most states. Most eviction notices are 30 day notices, which the tenant can fenangle into a 60 or 90 day ordeal in some states. Considering the abuse, you may be able to get it knocked down to a 7 day or a 3 day notice. Don't just change the locks on him... he has the right to sue if you do that without getting a paper or authorized audio recording of him saying something like "i'm vacating the property on mm/dd/yy" which you should try to get anyways so he doesn't come back. Edit: an authorized recording is one where you ask their permission to record on tape and receive it in clear an unequivocal terms. I really like Trahern B's answer about the social services for the elderly.

This is only a US answer. If you have a rental agreement and you are abiding by the rules (paying on time, no pets, etc.) they can't kick you out. However, if you have no agreement, then a month-to-month status is assumed. They have to give 30 days WRITTEN notice that they want you out. Then, you have to go.
