Many moons ago, I awarded Grassy a best answer which is the reason he made level five and now has unlimited questions.

You can, but as others have said you won't win. The fact he FedEx'ed the check as soon as he realized the error is good faith on his part. He can easily claim you gave him the wrong email from the start and you have no way to prove you didn't. Court is not worth the time and effort for what little you have to gain. Be thankful you had a landlord decent enough to realize his error and move on...
