Ouch, thats a tough one! I guess it depends on the amount of money you got over paid and for how long it was happening. If payroll didnt realize you quit, and has been paying you for three months, then I would think they have to take that loss for thier own lousy communication. If there was an extra zero added to your paycheck then that is a clear mistake and It would be wise to return the money that you know is not yours. I think you should be honest and return the money to them if you are thinking you might need to use this company as a referral or on your resume in the future. Legally, I dont think they can do anything about getting the money back from you unless they have clear evidence of the amount of hours you work compared to the cashed checks that they paid you with. Do remember though that if the job you have now does not work out, this situation might make it difficult for you to ever return to your previous place of employment for work.

Yes, they are. The wise thing to be on your end is to carefully review your check for any mistakes. I used to process payroll for a very large company, the payroll people at each nursing home location would submit their payroll to us to be process and we had to hope that they entered people correctly - entered hours, rates, etc. because the nurse aids were not about to report any errors and would get so pissed once they were discovered and taken back later on.
