Hello you can get a divorce for a dollar since hes in prison..Talk to a lawer in your area.

In the UK the judge must agree that your marriage is over and has irretrievably broken down. Grounds for divorce are: -adultery -unreasonable behaviour -desertion - after two years -two years' separation, if you both agree to divorce -five years' separation, if there is no agreement to the divorce You can do it on line (see link) I would think that unless he has been in prison for over 2 years (desertion) or 5 years (separation ), your best bet is unreasonable behaviour. I think you'll find that deciding to live a life that gets you 'banged up' is considered unreasonable to most courts! Don't listen to anyone telling you to wait until he comes out, he had his chance to make a life with you but chose not to. I've just reread your question before submitting it and realized that you might be American as you talk about an attorney instead of a solicitor, and I'm in the UK, but I can't imagine the logic behind divorce will be too different even if the process may be. Go online and type in "divorce" you can do it yourself for like
200 dollars. You just fill out the forms yourself and file them at
the court house where you live.

your local library will have uncontested divorce papers usually around $3...if he agrees to the divorce, get the paperwork for $3 at library and then it only cost you filing fee...usually around $125.

make a court date and represent yourself

ask for the divorce and they will serve him in jail

go threw legal aid in your state its a low cost or no cost depends on your income
