8 years my parents have been divorced. He is a jerk and thinks he owes us nothing since my mother left him. He was ordered to pay child support and never has. He owes I think 18,000 in back child support. I am now 20 and my brother is 17, will be 18 this year. My mom is going to court today for the child support and my dad says he is going to strip her of everything. What are the chances of my dad winning this and can my brother or I take our dad to court to either get the money for my mom or to at least help her? My dad is an awful man, he's had the money and never wanted to pay...he's 60 now and never worked for someone, only himself.

My dad won't even give the money to us and I see it as being rightfully my mothers money because she solely supported us and if he had been paying her it would have gone to her anyways. I basically see it as a refund of his half that she has always put in even when they were married. My dad is a con and he black mailed my mother so she stopped the enforcement for awhile but he never lived up to the signed agreement either.

No doubt about it. He can't take anything from your mother. He owes a large amount of money that is rightfully your mothers. No matter who sues him for it, you can all three be a part of the trial as witnesses. Make it a family event and all three of you can see his face when the judge tells him how much he has to pay. If it goes to court, there is no way he can avoid it. I would definitely be going for that money. I am sure the money would help your mom out. You never know, the judge may order him to pay more, depending on his income over the years. I hope it all works out for you. Good luck.

How does he keep from going to jail? I would think that he would go to jail or pay. Thats how it works for most guys. You and your brother can sue him for the child support as it should have been your money in the first place. he may be more willing to give it to you rather than to your mom as it sounds like it was a bitter divorce.

He can not strip your mother of anything. And yes you can take him to court. Just get a great lawyer.
I know in FL that when My ex did not pay child support and I reported him He went to jail for not paying.
