discovered that it has been terminated. He does very little to be with or see his son so I feel very strongly that this is the least he should do to help raise his son. I have very little financial resources to file leagal papers against him for being in default of the divorce court papers. Does anyone have any suggestions on how I can hold him accountable to fullfill his parental duty and avoid legal costs? thanks!

You're not trying to hold him in default, you're trying to get him held in contempt. Big difference.

Check with the local courthouse to see if they have "pro se packages" where you buy the forms that you need and just fill in the blanks yourself. If not, check to see if the local bar association can help you hook up with a lawyer that won't charge an arm and a leg.

Go to the court house yourself and ask one of the employees what type of paper work has to be filed. She can tell you how to address the letter/motion what it has to include and go home and type it yourself. Go back to the court and file it with the clerk and you will get a date in the mail for the hearing. I did my own divorce pro se and all I had to pay was the filing charge of about $100.00. I bought a book from the state for $15.00 and it had all the examples of what to do for paperwork etc. It was real easy and actually fun as I learned about the system. You don't need a lawyer to do this. People represent them self everyday in court.

Well if your son requires medical care take him. Talk to him (the father) and find out why he let the insurance lapse. (i know you said you wanted to avoid the cost). Apply for as much state funds that you can receive and THEN let them know the situation with the insurance. The state will then take him to court because they have been paying for it while he should have.

sorry but your only recourse is the courts; perphaps in your state you can find some free legal assistance; surf the web for that or start making calls "downtown" where I live this is available to folks with little financial resources.
