I cant find the box either it was acot mobile for my daughter and cost £34.99 from mothercare, the item is their own product as it has their logo on the item, but where do I stand on taking it back can I ask for a refund instead of replacement/gift vouchers without the packaging or receipt? Cheers

I have located the item on my bank statement, as I paid by card surely this is proof of purchase and I can ask for a refund as the item is faulty??

The item has to be fit for its purpose. You need to be sure that it is faulty as well, not being used incorrectly, has appropriate batteries in it as well - they are not covered!
And you do get a years guarentee too, even if it is not stated.
If resolved then ok, if not make a stand and speak with the manager. if still not resolved, tell others at the till area that this is shoddy service and tell them not to buy from this store - managers act quickly to resolve the matter.
If they ask you to leave, do so, but stand outside the shop and tell ingoing customers you woes from this store..... That works so well!!!
failing this get your trading standards dept to intervene on your case due to 'managerial intransegence'..... a great help and phrase!

As it is Mothercare I would give it a go, especially as you have located the item on your credit card. The item is faulty (not an unwanted Christmas Present). They will refund the money back to your credit card. You have your consumers rights so don't let them put you off.

This isn't a stupid question. You might be able to return it to the store. You'll need a photo id. As long as the item still has the tags you should be safe. You might also need the credit card that you charged the item to. The store might not give you cash, but they should give you store credit.

Speak with their head office direct after having tried with the branch itself, keep your bank statement handy and take a copy (blotting out personal details) of your bank statement, and speak with your credit card company .... they may be able to put a stop on the payment going through (if it hasn't already) .....
last but not least, as already advised, speak with trading standards who may be prepared to support and speak with the company on your behalf, if the company is being awkward ....

Under the purchase of goods act you are entitled to refund or replacemet,but with no reciept how do you prove you bought it and are not just returning stolen goods for cash?Not saying it was stolen but looking at it from their point of view

Have a chat with them. If you seem pleasant and don't berate them then I suspect they will return your money. Its not their fault it doesn't work. Do it now as they will be on a time limit with their suppliers. I doubt that they manufacture anything. The law is on your side but don't bandy that about as it will get up their noses

Depends on the store policy. Most places at least require the original packing and will give you store credit.
