I was told that the test they used was never wrong. I hadn't been using at the time had quit due to frequent randoms so it wasn't worth it to use. It came back positive, I was shocked and pissed. It was so high it was like I had just smoked or something. They sent it to lab they said but this was after I had been gone for like 20 or 30 minutes and chain of custody had been breeched because it was sealed after I came back. I went and had another test within 5 days that was sent to lab that came back negitive. I am fighting for custody and they are using the first test against me. But I had taken several that were negitive before and after this test is there a way to impeach the positive one? Help need case law on this

In this situation you really should have some legal representation to assist you so you don't miss any detail which could be key, but more importatntly so you have zero possibility of saying anything which could be construed as an incriminating remark. If you can't afford counsel you might still contact a local attorney for some advice via a free initial consultation. Another option may be contacting the ACLU for advice. Good Luck!!

Well what was the drug? When was the urine taken and when was the last time you used it before you "quit"? Different drugs stay in the body for different amounts of time so it is hard to answer this question without further information. You could have submitted a positive urine if you quit using even a week before, depending on the drug. And yes, if 5 days after you were re-tested it could be negative. If I were you I would quit for real NOW; I have a feeling you are not being truthful about your quitting drugs.

I was drug tested every month for years and they always sealed it in front of me and then I signed a paper. So yes I think the chain of custody was broken.Do you know anyone on a methadone program? That's what I was on and they can help you find out for sure what to do.Or at least they can ask their counselor.Or go to your methadone clinic and ask to speak to a counselor. The reason I suggest this is because they have to drug test everyone once a month there.As long as you don;t ask about a specif person they MIGHT help you.
