My bf's brother was living in this apt with his gf for a yr and their contract was up and she was moving back to Japan. But my bf's bro wanted to continue living there but his credit isn't good. So he asked me to sign the contract.I didn't want to do it but my bf needed a place to stay.So I felt pressured to sign it so I did. But I didn't sign a year contract.It was a month to month contract. I was still living with my parents. A month later I moved out with my bf to our own apt. I told the landlord I wasn't living there and I wanted my name off the contract. He told me he sent my info to his lawyer to sue me for not paying rent. My bf's bro didn't pay rent. It's been several months and I continued calling him to tell him to remove me from the contract and to just keep the deposit. If my bf's brother abandon's the place or wrecks it. Can the landlord sue me even though I told him that I don't live there and I asked him to remove me from the contract?

Should I send a written letter now?I signed the contract in July. I asked to be removed from it in September. I didn't even have the landlords phone number. I worked for a mortgage company and used my resources to find out who owned the apt and where the owner lived. I then went to his house and explained everything to him. He said he would tell my bf's brother to get someone who actually lived there to sign the contract. He kept trying to contact my bf's brother. But my bf's brother wouldn't answer his calls or his letters. He still lives there. I know you said I would be responsible for the back rent. But my bf's bro already paid it but he's just been late every month. Will I not be responsible for the rent after September. Since that is the month I asked him to remove me from the contract. If not, should I send him a written letter ASAP?

Also would I be responsible for the damages after September? Since I did talk to him in person about taking me off and he did tell my boyfriend's brother to just give him the information of everyone living in the apartment. He said he didn't care if they had bad credit anymore as long as they paid rent. My bf's brother never answered the landlord. So I heard from my bf's little sister that they were being evicted. Does that affect me in any way?

You are on the hook until the day you told the landlord to take your name off the agreement, hopefully you did it in writing or in accordance with your agreement. It's the landlord's duty to mitigate his damages. In other words, he needs to make reasonable effort to stop his losses. He should have notified the other party on the lease that he was evicting him on the first opportunity (probably one month later.) If he continued to lease to him after you notified him, it's his loss. Contact the legal aid program where you live if you are indeed served.

You are on the hook for the back rent, but nothing after you told him you wanted to end the contract. Any damage to the apartment is also your responsibility because you signed the contract. On the bright side, you can sue your boyfriend's brother.

You should have sent the land lord a letter in writing keeping a copy for yourself . always put it in writing. Never just call a person. Yes he can probably sue you and win. You did not follow through. I would beat the He-- out of your boy friend and makehim pay for his brothers rent.

Yes he can....you shouldn't have signed something like that, knowing you weren't gonna live there and your brother is a deadbeat. The landlord certainly is within his rights to sue you and get money for back rent. It doesn't matter that you didn't live there, you signed the lease like you DID.

Of course the landlord can sue you. That's why he had you sign a contract. Not everyone is as naive as you.

Unfortunetaly yes he can, you have signed the lease for your friend. You not living there has nothing to do with the contract. The contract was in your name and you would be responsible for any non-payment of rent.

I believe that he can. You should hire a lawyer to defend you and to sue your bf's bro.
