The test, as laid out by the Supreme Court in Roth v. United States (1957) of whether something is obscene is whether, to the average person applying contemporary community standards, the dominant theme of the material taken as a whole appealed to prurient interest.

The Court added, in Miller v. California (1973), that court should consider whether the work lacks serious literary, artistic, or scientific value.

Potter Stewart did say, "I know it when I see it" which is often referred to as the "Erection Test."
