I rent the lot my trailor sits on. right now my pipes are frozen, but since i have a septic tank i am able to flush the toliet with water i get from the spring or whereever, but for the last day or so when ever we go to flush it, it doesnt want to flush, it backs up into my tub, so im guessing either my septic is over full, ( we have lived here for four years and it hasnt been pumped) Since the septic is underground on the land whose responsiblility is it to pay for the it to be pumped and can it be pumped in the winter?

Yes a septic tank can be pumped in the winter.

As to who has to pay, that is determined by your contract. You do have a contract right?

Or, go sit down with the owner of the land and talk to him. Are you the only trailor/house that uses the septic? If so I would say it is your responsibility unless your contract says otherwise.

It sounds like it might be frozen pipes in and above the ground coming from the septic tank. You could get under your home and insulate those pipes, also using heat tape. The cold snap should be about over unless you live in Greenland, and I hear that's warming up, too!

Goodness sake, call your landlord and ask him! I'm sure he knows what to do, its probably happened before. You don't need a lawyer, you need to get to work.

i do not know whether it can be cleaned and pumped out in the winter, and i do not know whether that in itself is really the problem. ask a sewer specialist. else:

you need to read over the documents that you signed when you closed on the purchase, as well as any documents that exist for the trailer park you are situated in, if there is one, such as a homeowners' association. you also should read the lease that you have which should outline what the owner's responsibilities are, and which are yours.

if, after you have read these documents, you still cannot decide who is responsible for this problem, please call a real estate attorney.
