Is it just me or has any body else gotten a ticket that is one mile under wreckless driving...followed by the cop saying "I'm doing you a favor..i'm only going to charge you with speeding" isn't that lying under oath? wouldn't a case get dismissed that way.. even if you were going faster than that?

In this case, it's very possible that an officer gave you a ticket for speeding. However, a city/county/district attorney can review the case and amend the original charge into something more or something different.

In other instances, police are legally allowed to lie to you. If they are seeking information about a crime or even a confession, they can tell you things like, "If you just tell us what you know we'll make sure you won't get charged."

Thank the Supreme Court for that one.

Is the officer under oath--no, that happens when you make a statement in court. In different communities they give the right of "Officer Discretion" to lower the civil infraction, give warnings by oral or in writing. In some towns where i have lived at/over 20 miles over the limit it is mandatory that you will be put under arrest--next town over they just have the "Right" to arrest. No, the case would not be thrown out--you would still be at least guilty of Speeding would you not !!?. That is why many people go on trial for manslaughter and 2nd degree murder during a robbery---why, they can prove you did kill a person--it's hard to prove that it was your intent to kill all along (even though you may have planned to). It is easy to prove that you were speeding--but had to prove that you were 20 miles over the speed limit and not 19.9 miles over the limit.
Officer do not have the "right" to lie--I'm not saying that they don't do it--But, they don't have any legal right to do it.When someone ask me if I was a Police Officer--all, I would say is "Do I look like one ?". I never told them that i was not one.

When the Goverment lies that other servants would lie too..

True or Lie is issue of Ethic... when the Ethic was attacked and destroyed...complaints have no power...

Remember the issue if 'faster' or 'slower' is not so important that you think about it...

Usually cops are doing their jobs....think also if you make a mistake...

IF..cops make mistakes...certainly judges would find....and case would be dismissed...

IF judges made mistake, as they do sometimes...then you can APPEAL his judgment...

SO, there is always a remedy that leaves no place or upset

Good luck...

It all comes down to credibility. An officer with a decent record has more inherent credibility than most citizens.

In your situation, what happened was definitely not perjury.
