It all depends. I filed for divorce (VA) and husband refused to sign or show up at court. My divorce was final within 30 days. I filed for mental and physical abuse tho, and had pics and Hospital documentation.

I'm not sure about NY but I think all that will happen is that the divorce will be considered "contested". Once a person is served with the papers, which are legal documents, they don't have any choice but to go through the proceedings. Honey, if he's going to be a d**k about it you better get a good attorney. If you're the one not wanting the divorce you need to rethink the situation.

I had a friend who was once
served divorce papers in NY state.
So-
She went to an attorney, and told him
she wanted to save her marriage-
and that she wanted to contest the divorce
on the grounds that her husband had no grounds
for divorcing her.
After listening to her story,
her attorney contacted
her husband's attorney,
and apprised him of the situation.
Shortly thereafer,
her husband received another bill
from his lawyer stating that
the fee for the divorce was
going to go up another $300-$500
since his wife had decided
to contest the divorce.
The husband gave up the fight-
and returned home.
Ten years later,
they are still married-
(and happy).

Why would one not want to sign divorce papers? Do you really think life would be better by forcing someone to stay married to you when they really didn't WANT to be married to you? Do you really think a marriage can be happy when one partner is totally miserable? What would the logic behind not signing be? Other than not agreeing to the terms...which can be rehashed in court. But if all the terms of the divorce are agreed upon why not sign? I can't imagine being that hell bent on being miserable for the rest of my life knowing my partner is miserable with me.

I would think that it is possible not to sign the divorce papers but despite that a judge will grant one anyways. I'm in SC and my ex husband tried that but it didn't work and the judge granted me my divorce anyways. I hope that helps you out!
