email to abuse@ebay.com
thy will reply, quickly.
at least that was my experience.
Depending on your situation file a report with the police and do the abuse email thingy. Their really isn't much else you can do.

first you must file a police report for the theft.

you will need to tell the police the auction # and the ID of the seller and the ID of the winning bidder.

then have the police contact ebay.

if the police are unwilling to help you, demand to speak to a supervisor.

you will need to be able to PROVE that the item DID and DOES indeed belong to you.

ebay works closely with law enforcement when asked.

but it must be the police doing the asking.

.DON'T give up.

many win this battle!

I would also go to the post office and obtain a mail fraud form. You know they are going to have to mail it and it is illegal to use the US mail to transact a fraudulent sale. In this case you would be the person being defrauded. I've found in the case of ebay sellers especially, they usually begin to see things your way when they receive the notice that a case has been opened against them. I hope this works out for you. My mail carrier put me on to it and it worked well for me. You might even want to mention this to the person who stole your item and sold it.

start by contacting Ebay, give them all the details of the person that sold your item, you may need to prove it was yours though they hold records of all transactions and can maybe sort out your problem, they will also be able to advise you where you stand if they can´t help you, I´m sure you´re not the first person this has happened too!

Easy enough, that is theft and fraud (taken something from someone without permission and selling goods over the internet without having title of possesion)
Go and see your nearest local policestation,
they will gladly help you.

I think you should go to the citizen's advice bureau, and find out if you have a legal case against them, and take it from there
