We have joint custody but they will be remaining in the US with their dad. I just want to be sure he will be able to make decisions for them if I cannot be reached.

It may would have to be giving him TEMPORARY custody. I would look into the papers and see if it says that you are the only one that can make decisions for them, if it says he has the same rights to make decisions when they are in his care I wouldn't mess with it. I don't think I would give him power of attorney though, he could really mess you up with that if he wanted to. I know when my husband leaves and I have power of attorney I could do all sorts of things to his finances and credit, I could even represent him in court if needed.

If you have jopint custody, you should need to fill out any power of attorney. But, if it makes you more confortable, you can do it, just remember to revoke the power of attorney when you come back into the country, because that will leave you with NO power!

Assign him temporary sole custody of the kids so they wont look for you in case of emergency. Make sure to include dates and get it notorized too, but include a phone number in case of a real emergency. Have fun

Why the heck would you leave your kids for a year????? Do you have some kind of cancer or disease that can only be done over there????

If not, shame on you for leaving your kids like that. I hate when parents ditch their kids to make themselves happy. Should've done that BEFORE the kids.

you can sign over temporary custody, make sure the order says that tho, or he can and probably WILL keep the children when you get home
