my sister is in a coma in the hospital and she has 2 son with no licence to drive, I want to protect the car from being impounded so I took the car and now the 2 sons called the police and said they was looking for the car, I am not sure if he even called or just trying to scare me to get the car back to party. was I wrong for taking the car ???

Who is the legal gaurdian? Are the boys underaged? If they are not the legal owners then it's likely there is no report and they are pulling a fast one. Contact an attorney and find out what you can legally do. Definately not embezelment. Auto theft, maybe.

This is neither GTA or embezzlement, since it's not your intent to keep the car. Both crimes have an INTENT element, and you don't have it.

If the kids were driving around, or there was a good chance they woul have, you're probally ok over all. If the kids are on thier own now, you might want to see an attorney about establishing a guardianship.

Otherwise, I agree that explaining the matter to the police is a good idea.

First, why would the car be impounded? Regardless of whether or not your nephews have a license or not should have no bearing on whether or not the car is impounded.

Second, since your nephews are unlicensed, i assume they are minors and they are subject to supervision. If your sister does not have someone to look after her affairs, then you as her next of kin have the right to make these decisions as well as to look out for the best interests of your nephews, assuming they are minors.

Tell your nephews that if they don't get into line and behave that you will call family services and get a court order to act as their guardian until their mother comes out of the coma.

Don't let them bully you. You are the responsible adult here.

If your sister is in a coma, someone should be appointed to handle her affairs. That person can do what they want with the car. Any attorney can advise you about getting appointed to handle her affairs. Unless she left a power of attorney, the court would have to make such an appointment.

Go down to the police station and explain the situation to the desk sergeant. File a report, to document your actions. This will prevent any criminal charges but, you might have to give the car up.

Unless the car is titled in your name, you have stolen it. There is probably a legal way you can handle this...right now, it is grand theft auto.
