If your attitude with him was anything like your attitude here, it would be really tough to prosecute him- the court would rule it justified.
Basically this is your word against his, and attitude in the courtroom counts in a situation like this- but his being an officer will count for a lot as well.
Witnesses, sure if you do this witnesses would make a big difference, but if they are having intercourse in the court room they will probably count against you.
