Next of kin if they are adults. Contact a family law attorney and make the necessary arrangements. It is imparitive especially if there are minor children involved. Someone needs to take charge and be responsible for what could be life of death decisions.
And then get yourself a will.

The court will apoint someone usually if the patient is under 18 the court appoints the father or mother. If the patient is older then 18 usually the spouse, son, or daughter.

If you find that you want to have custody over the patient, you should speak to an attorney.

there husband or wife persuant to dr permission for needed input
without court orders.
it takes awhile to gain court orders for this once it has happened.
husband of wife can usually get court to act soley in there part quicker than others if resistance is meet with from the hospital or dr's.
at this point hospitals and dr's can react by overbilling to the responsible part and usually do when disagreed with. they have responses also dont they
